On August 2, 2026, the next wave of EU AI Act obligations takes effect. After the prohibited practices ban that came into force on February 2, 2025, the transparency requirements under Article 50 now become mandatory. Every organisation in Latvia that deploys chatbots, generates synthetic content, or uses emotion recognition or biometric categorisation systems must comply.

Who is affected

The transparency obligations apply broadly — not only to AI system providers, but to any organisation that deploys these systems. If your company uses a customer-facing chatbot, generates marketing images or text with AI tools, or uses AI to categorise or assess individuals, you are within scope.

This includes public institutions, municipalities, banks, insurers, telecoms, retail companies, and any organisation that interacts with individuals through AI-powered interfaces.

What must be done by August 2

  • Chatbot disclosure: any person interacting with an AI system must be informed that they are interacting with AI, not a human — unless this is obvious from the circumstances.
  • Synthetic content marking: AI-generated or manipulated image, audio, video, or text content that is published must be marked as artificially generated in a machine-readable format.
  • Emotion recognition and biometric categorisation: individuals subject to these systems must be informed and give consent where required under GDPR.
  • Deep fakes: AI-generated content depicting real persons or events must be disclosed as artificially generated.

The inventory problem

Most organisations do not yet have a complete inventory of AI systems in use. Shadow AI — tools adopted by teams without central oversight — is widespread. Without a structured register, it is impossible to determine which transparency obligations apply to which systems.

This is not a one-off task. The AI Act requires ongoing conformity management: classification, obligation tracking, evidence documentation, and lifecycle monitoring as systems change, update, or are replaced.

From inventory to demonstrable conformity

Kas ir skarts

Pārredzamības pienākumi attiecas plaši — ne tikai uz MI sistēmu nodrošinātājiem, bet uz jebkuru organizāciju, kas šādas sistēmas izmanto. Kas jāpaveic līdz 2. augustam

  • Čatbotu atklāšana: jebkura persona, kas mijiedarbojas ar MI sistēmu, jāinformē, ka tā sazinās ar MI, nevis cilvēku — ja vien tas nav acīmredzams no apstākļiem.
  • Sintētiskā satura marķēšana: MI ģenerēts vai manipulēts attēlu, audio, video vai teksta saturs, kas tiek publicēts, jāmarķē kā mākslīgi ģenerēts mašīnlasāmā formātā.
  • Emociju atpazīšana un biometriskā kategorizācija: personas, uz kurām attiecas šīs sistēmas, jāinformē, un jāsaņem piekrišana, ja to pieprasa GDPR.
  • Dziļie viltojumi: MI ģenerēts saturs, kas attēlo reālas personas vai notikumus, jāatklāj kā mākslīgi ģenerēts.

Inventarizācijas problēma

Lielākajai daļai organizāciju vēl nav pilnīga izmantoto MI sistēmu inventāra. Ēnu MI (shadow AI) — rīki, ko komandas pieņem bez centralizētas uzraudzības — ir plaši izplatīts. Bez strukturēta reģistra nav iespējams noteikt, kuri pārredzamības pienākumi attiecas uz kurām sistēmām.

Tas nav vienreizējs uzdevums. MI akts pieprasa pastāvīgu atbilstības pārvaldību: klasifikāciju, pienākumu izsekošanu, pierādījumu dokumentēšanu un dzīves cikla uzraudzību, sistēmām mainoties, atjauninoties vai tiekot aizstātām.
